Ex-Goldman director gets two years for insider trading

NEW YORK (Reuters) - Disgraced Wall Street titan and philanthropist Rajat Gupta was sentenced to only two years in prison, a much lighter sentence than U.S. prosecutors had demanded, even though the federal judge who imposed it on Wednesday called his insider trading crimes "disgusting" and "a terrible breach of trust."

Gupta was also ordered to pay a $5 million fine. He was convicted in Manhattan federal court last June for leaking Goldman Sachs boardroom secrets to Raj Rajaratnam, the hedge fund manager at the center of a U.S. government crackdown on insider trading over the past four years.

Some legal experts said the sentence came as a surprise, while others said the judge struck a fine balance.

U.S. District Judge Jed Rakoff told a somber courtroom audience, including Gupta's wife and four adult daughters, that the illegal sharing of corporate secrets at the height of the 2008 financial crisis "was the functional equivalent of stabbing Goldman in the back."

Gupta, 63, gave no visible reaction to the sentence, which was given at the end of a 30-minute statement in which the judge spelled out the businessman's "extraordinary" philanthropy over decades that stood in stark contrast to his crimes.

Bill Gates, Microsoft Corp's co-founder, and former United Nations Secretary-General Kofi Annan were among 400 friends and luminaries who had written letters to the judge urging leniency.

During Gupta's trial, the court heard how Gupta had tipped off his then friend and business associate Rajaratnam between September and October of 2008. Within minutes of a conference call of members of Goldman's board on September 23, 2008, Gupta told Rajaratnam that influential investor Warren Buffett was infusing $5 billion into the investment bank. Rajaratnam traded on the information as the market was closing.

In his statement on Wednesday, the judge said the tip "was not only overwhelming, but it was disgusting in its implications ... a terrible breach of trust" at a time when Goldman Sachs was in turmoil.

But the judge also said: "I have never encountered a defendant whose past history suggests such an extraordinary devotion ... to people in need."

Rakoff ordered Gupta to begin his sentence on January 8, 2013. He denied Gupta's lawyer's bid to have him freed on bail pending an appeal, which could last as long as two years.

The former Goldman director is the most influential corporate figure to be convicted in the wide U.S. probe of insider trading involving fund managers, traders, consultants and executives. He is a former global head of the McKinsey & Co management consultancy, and once sat on the boards of Procter & Gamble Co and American Airlines as well advising philanthropies including the Bill and Melinda Gates Foundation.

Gupta's sentence was less than the eight to 10 years sought by prosecutors, but more than the punishment of probation and community service in Rwanda that Gupta's lawyers had proposal. The judge dismissed that proposal as "a kind of Peace Corps for insider traders."

The sentence was also less than some other insider trading defendants who went to trial and received four, five and even 10 years imprisonment. Rajaratnam is serving an 11-year prison sentence, one of the longest for insider trading.

Assistant U.S. Attorney Richard Tarlowe on Wednesday argued for a sentence of at least eight years, telling the court "Mr Gupta knew as much about the sanctity of these types of corporate confidences as anybody, and that's what makes it so shocking."

New York securities class action and shareholder rights lawyer Mark Rifkin said the judge "understood both sides of the argument, and the relatively light sentence he imposed balances Gupta's misuse of his position against a lifetime of good work."

But Andrew Stoltmann, an attorney and investor rights advocate based in Chicago, wondered whether Gupta's "Mother Teresa-like halo" had warranted a sentence that was "little more than a slap on the wrist."

"He had such an important role at some of these companies that it is kind of the ultimate betrayal of trust."

When Gupta took his turn to address the court, he read for six minutes from a prepared statement, using bland language that stopped short of fully admitting his conduct, but apologizing to "extraordinary institutions and outstanding people" he knows and to his family.

"I feel terrible that they have been burdened with totally undeserved negative attention. I apologize to them and ask for their forgiveness."

Federal judges have wide leeway in sentencing, and Rakoff has a reputation for veering from guidelines designed for courts in handing down punishment. Gupta had faced a maximum sentence of 20 years for securities fraud and five years for conspiracy.

Gupta's lawyer, Gary Naftalis, arguing for a lenient sentence, said his client had suffered a "fall from grace of Greek tragedy proportions."

"This was an iconic figure who had been a role model for countless people around the globe," Naftalis said. "He is no more."

The case is USA v Gupta, U.S. District Court for the Southern District of New York, No. 11-cr-907.

While the super-rich get a tax cut, disabled people are the hardest ...

Another day, another story about welfare reform.

Last week, the BBC ran a story on the government?s flagship welfare policy, the Universal Credit. A report by Baroness Tanni Grey-Thompson revealed up to 450,000 disabled people and their families stood to lose out as a result of the reforms; today, Mark Hoban, the employment minister, warns jobseekers who repeatedly refuse to ?play by the rules? could lose benefits for three years.

Anti-disability-benefit-cuts-protestersIs anyone listening? Amazingly, despite the almost dizzying release of case studies and statistics, welfare reform still appears to resonate as a news story.

The government thinks it is on to a good thing focusing on welfare. The Chancellor of the Exchequer?s recent announcement setting out plans for a further ?10 billion cuts in the welfare budget, on top of the ?18bn already being cut in this Parliament, shows the government?s intent.

But amidst all these announcements, on further cuts to come, on a zero tolerance approach to the ?workshy? and so on, it is increasingly unclear what the government means when it says we still have a ?safety net? to protect the most vulnerable in society.

The Hardest Hit coalition, which brings together more than 90 disabled people?s organisations and charities (including Sense, Mind, Mencap, Parkinson?s UK, the MS Society, The Stroke Association and RNIB), believes more needs to be done to raise awareness of the human and economic impacts of the cuts now underway.

After all, disabled people face a double penalty: extra costs and lower incomes. Our new research (pdf) shows nearly 9 in 10 (87 per cent) of disabled people say their everyday living costs are significantly higher because of their condition. We have recently surveyed more than 4,500 disabled people on changes to benefits. The verdict is in: disabled people and their families are struggling to make ends meet.

Yet in our view cuts to Disability Living Allowance (DLA) and other vital benefits risk intensifying disability poverty. Nine in ten DLA claimants fear a loss of DLA income will lead to deterioration in their health. Yet the government plans on cutting the numbers receiving Disability Living Allowance by half a million people.

The Hardest Hit coalition?s new report, ?The Tipping Point? (pdf), features the stories of disabled people facing tough choices on whether they can afford to heat their homes. Or whether they have enough money to buy pre-prepared food, which tends to be more expensive but many disabled people, such as those who cannot see, find it much easier to cook with.

As part of our research, disabled people told us they feel they are being targeted for cuts. Forty thousand people who paid into the system in good times but have now fallen on bad times lost ?90 of Employment and Support Allowance in April 2012. Cuts averaging ?52 a week for claimants receiving contributory ESA as a result of illness or an impairment will affect 400,000 disabled people by 2013/14. So where is the safety net?

Frustratingly, stories concerning disabled people facing tough choices tend to play second fiddle to DWP-press releases on the numbers of people being found ?fit for work?. What?s different about the Hardest Hit coalition?s story? We want to use the coming week to explain, to focus Parliamentarians? and the media?s minds on the real issues at the heart of the welfare debate.

Unless urgent changes are made to the assessment judging people?s fitness for work or indeed to Personal Independence Payment, disabled people?s slide into entrenched poverty and isolation will be the ultimate legacy of this government?s welfare reforms. Disabled people are at a tipping point but so too are politicians.

The government can press ahead with unfair cuts that our analysis suggests are a false economy or they can rule out targeting disabled people as part of the next spending review.

We need MPs to recognise disabled people are already the hardest hit by the cuts and must be protected in future decisions on benefit reform and deficit reduction. Beirut bombing sparks protests aimed at Syria

BEIRUT -?Protesters burned tires and set up roadblocks around Lebanon on Saturday in a sign of boiling anger over the killings of a top security official and seven others, while Lebanon's prime minister said he suspected a Syrian connection in the bombing.

At a press conference, Prime Minister Najib Mikati?said he suspected the bombing was related to the indictment in August of former minister Michel Samaha, a supporter of Syrian leader Bashar al-Assad, over a plot allegedly aimed at stoking violence in Lebanon.

"I cannot separate in any way the crime that took place yesterday and the discovery of the conspiracy against Lebanon in August," he said.?

Other?Lebanese politicians have also accused Assad of being behind the attack, deepening fears that Syria's sectarian-tinged civil war is spreading to its neighbor.?

NBC News producer Paul Nassar reported an unusual calm had swept over Beirut.?

"The city is dead, absolutely quiet," Nassar, reporting from Beirut, said. "All the major shopping districts are closed -- this city would usually be brimming with activity, but now, nothing."


Nassar added that the bomb was an especially devastating blow to the city because it came on the cusp of the major Islam holiday Eid, which starts next weekend.

"Hotels that were close to capacity are now looking at 20 percent" of rooms full after tourists scrambled to cancel their reservations, Nassar reported.

In the eastern Bekaa Valley region, the Lebanese army opened fire on a group who were blocking a road to protest the bomb attack, wounding?two people.

"The Lebanese army were trying to open the road and started firing their guns," a witness from the village of Bar Elias, told The Associated Press.

Meanwhile, the Lebanese Cabinet held an emergency meeting as the country's opposition called for Mikati to resign.?

The government declared a national day of mourning for the victims, who included Brig. Gen. Wissam al-Hassan, head of the intelligence division of Lebanon's domestic security forces. Dozens were wounded in Friday's blast in Beirut's mainly Christian Achrafieh neighborhood.?

Many observers said the attack appeared to have links to the Syrian civil war, which has been raging for 19 months. Al-Hassan, 47, headed an investigation over the summer that led to the arrest of former Information Minister Michel Samaha, one of Syrian President Bashar Assad's most loyal allies in Lebanon.?

Samaha, who is in custody, is accused of plotting a campaign of bombings and assassinations to spread sectarian violence in Lebanon at Syria's behest. Also indicted in the August sweep was Syrian Brig. Gen. Ali Mamlouk, one of Assad's highest aides.?

Al-Hassan also played a role in the investigation of the 2005 assassination of former Lebanese Prime Minister Rafik Hariri with a massive truck bomb. A U.N.-backed tribunal has indicted four members of militant group Hezbollah, which along with its allies, now holds a majority in Lebanon's Cabinet. Hezbollah denies involvement in Hariri's killing and has refused to extradite the suspects.?

Al-Hassan's department also had a role in breaking up several Israeli spy rings inside Lebanon over the past few years, Lebanese officials said.?

Lebanon's fractious politics are closely entwined with Syria's. The countries share a web of political and sectarian ties and rivalries, often causing events on one side of the border to echo on the other. Lebanon's opposition is an anti-Syrian bloc, while the prime minister and much of the government are pro-Syrian.?

The civil war in Syria has laid bare Lebanon's sectarian tensions as well.?

Many of Lebanon's Sunni Muslims have backed Syria's mainly Sunni rebels, while Shiite Muslims have tended to back Assad. Al-Hassan was a Sunni whose stances were widely seen to oppose Syria and Shiite Hezbollah, the country's most powerful ally in Lebanon.?

Lebanon's top Sunni cleric, Grand Mufti Mohammed Rashid Kabbani, condemned the assassination, calling it a "criminal explosion that targets Lebanon and its people." He called for self-restraint saying that "the criminal will get his punishment sooner or later."?

Police and army troops sealed off the site of Friday's blast as military intelligence agents investigated what was the deadliest bombing in Beirut in four years.?

Sharbal Abdo, a Beirut resident who lives down the block from where the car bomb detonated, on Saturday brought his six-year-old son Chris and 12-year-old daughter Jane to see what happened the day before. They were both at school when the blast ripped through the area.?

"They were very afraid yesterday, and cried a lot late into the night," Abdo said. "Today I decided to bring them here and show what happened. They need to face this situation. It may be their future."?

On Friday, protesters in mostly Sunni areas closed roads with burning tires and rocks in Beirut, the southern city of Sidon, the northern city of Tripoli and several towns in the eastern Bekaa Valley.?

The highway linking central Beirut with the city's international airport was closed, as well as the highway that links the capital with Syria, the officials said on condition of anonymity in line with regulations.?

Rafik Khoury, editor of the independent Al-Anwar daily, said the assassination was an attempt to draw Lebanon into the conflict in Syria, which has been the most serious threat to the Assad family's 40-year dynasty.?

"The side that carried the assassination knows the reactions and dangerous repercussions and is betting that it will happen. Strife is wanted in Lebanon," Khoury wrote.?

A fight at a local tattoo parlor led to an Interstate 25 chase, as Colorado Springs police and Colorado State Patrol searched for a possible shooting victim.

Just after 7 p.m. on Saturday shots were reported at the Pins and Needles Tattoo, at 3737 Drennan Road, where police were told that a man was shot. Police found no shooting victim, just shell casings and the front bumper that was sitting in the lot off a car stolen from Denver, police said.

The tattoo parlor was hosting a rap contest, featuring artists from around the country, police said. Witnesses told police that one rapper got in an argument with others, and then walked to his car in the parking lot, and shots were fired at him. He drove away, leaving his bumper behind.

Shortly afterwards, Colorado State Patrol troopers reported that they were chasing the bumperless car north on Interstate 25, into Douglas County. The pursuit ended in a crash.

There was no further information available from either agency at 9:30 p.m.

The auto driver had driven his vehicle into the forest area of the campus with his wife, who was living separately. No arrests have been made in the case till date, reflecting the casual attitude prevailing among policemen over the issue of crime on the campus.

If the police had heeded the warning and taken some stringent steps to step up the patrolling and having check-posts within the campus in the wake of the September 27 incident, perhaps the Saturday crime might not have happened at all.

Police, however, claim that they have taken several steps to ensure that the rule of law prevails on the sprawling Bangalore University campus. They cite the incident of including transferring of a police inspector who was "not performing".

Ironically, on Saturday when the incident took place, all the officers including the deputy commissioner of police were on night rounds. As claimed by a senior police officer, the very road where the couple's car was parked was blocked by the officers but yet the incident took place.

This crime incident was a repeat of a similar gang rape that took place seven years back on the campus. In 2005, a 30-year-old woman was raped by a gang of taxi drivers. She was repeatedly raped and found in an unconscious state. From that time, there were many plans made to restrict the movement of outsiders within the campus. New gates were erected and plans were made to restrict the movement of traffic within the campus at night, but under the pressure from BBMP and the residents living nearby, this plan had to be shelved.

Threatwatch: Can we really spot covert nuclear tests?

In 2010, two strange clouds of radioactive material drifted over the Far East. The clouds' make-up suggested that North Korea had tested two more nuclear bombs.

Seismic monitoring experts now say this was a false alarm. Any explosion was vanishingly small, they say, because seismometers should have picked it up ? and didn't. Other nuclear experts aren't so sure.

We need to know if there was a test. North Korea's own nuclear ambitions aside, the country has been accused of testing weapons for Iran.

And in the long run, the issue is whether science can reliably spot nuclear blasts. That will determine whether we can enforce the 1996 treaty banning nuclear tests: a treaty that Barack Obama vows to ratify, and that US Republicans oppose.

Nukes, nukes everywhere

The US and Russia have, between them, 18,000 nukes, and seven other countries possess a thousand-odd more. Global treaties aim, at the very least, to prevent any more countries arming themselves.

Although most countries approved the Comprehensive Test-Ban Treaty (CTBT) in 1996, it has yet to come into force, because eight nuclear states refuse to ratify it, including the US.

However, treaty members did build the International Monitoring System (IMS), which spots nuclear tests using seismometers, sound and radionuclide detectors. IMS seismometers picked up North Korean tests in 2006 and 2009.

On 13 and 15 May 2010, IMS stations in Russia and Japan, and another run by South Korea, detected clouds of barium, lanthanum and xenon isotopes in air from North Korea. Some had clearly been produced recently by nuclear fission.

Such clouds can stem from accidents at nuclear reactors. However, Lars-Erik De Geer of the Swedish Defence Research Agency in Stockholm realised that these clouds lacked other elements produced by accidents. But they did contain barium isotopes, only seen after accidents or nuclear tests.

Twin tests?

Other data was inconsistent with a single explosion. Putting it all together, De Geer deduced that North Korea carried out two tests, on 15 April and 11 May. Some nuclides leaked, and a few days later blast doors at the underground test site must have opened and released more (Science & Global Security, doi.org/jhg). Worryingly, though, any blasts did not get picked up by seismic monitors.

After analysing the nuclides, Gerhard Wotawa of the Central Institute for Meteorology and Geodynamics in Vienna, Austria, concluded that their masses suggested a 50-ton blast. While that is still big enough to amount to a useful bomb, it would only just have been detectable seismically, according to De Geer ? making the failure to spot any such signal less of a surprise.

Paul Richards of the Lamont-Doherty Earth Observatory in New York City disagrees. "We would have seen that," he says. He looked for shock waves similar to earlier tests in data from a Chinese seismic station near North Korea. There were none, even though his calculations show any explosion of more than a ton should have been detectable.

Or false alarms?

A 10-ton blast could be hidden by isolating it from the surrounding rock, but Richards says such a tiny test has little military value (Science & Global Security, DOI: 10.1080/08929882.2012.711183). He thinks De Geer's suspected tests are false alarms.

De Geer says North Korea might have tested small "hydronuclear" reactions that boost warheads. But Hans Kristensen of the Federation of American Scientists in Washington DC says a more likely explanation is that North Korea conducted the usual test on two occasions, and that both failed.

Failed tests might still emit nuclides, because they don't seal the surrounding rocks. That is what happened in the 2006 test. By contrast, the 2009 test was successful, and no nuclides were detected.

Monitoring works

Whatever really happened, the incident suggests the IMS is working. It detected a nuclear incident, involving a much smaller explosion than the system was originally expected to detect. "Existing verification would make it very difficult for a country to conceal a test [of] a militarily usable nuclear warhead," says Kristensen.

"There are fewer and fewer grounds for countries to refuse ratifying the CTBT by questioning the effectiveness of its verification," agrees De Geer.

According to a leaked roadmap on TMoNews, the magenta carrier appears to have a few tantalizing offerings coming its way this holiday season. A curious BlackBerry handheld dubbed the Armstrong, a color refresh of the Samsung Galaxy S II, a possibly Android-flavored Huawei Summit and the LG Optimus L9 are all slated to launch just on or before Halloween. Going into the next month, we see the HTC Windows PhoneX making the pre-Thanksgiving cut with a potential debut of November 14th. Notably absent are the Samsung Galaxy Note II and the Nokia Lumia 810, but that doesn't mean they won't be there when December rolls around. Of course, this info didn't come through official channels, so we wouldn't bank on any of the handsets as holiday gifts just yet. Still, its nice to know they're coming, and you can get the full details on these and other devices at the source.

Sugar Addiction: Part Deux | Psychology Today

A few months ago, I wrote a blog post titled ?Sugar Addiction? where I questioned whether abstinence is the best treatment for sugar addiction. That post sparked discussion amongst my readers and the comments inspired me to write a follow-up to my original post.

There is a growing body of research showing that certain foods can have addictive properties for certain people. The similarities between some eating behaviors and drugs of abuse have resulted in use of the term ?food addiction.? The term ?addiction? is value-laden with strong associations to substance abuse. Abstinence has long been the primary mode of treatment for drug and alcohol addictions and it is the most widely accepted path to recovery. However, there are alternate methods of recovery from substance abuse, including the harm reduction model that has helped people to recover from substance abuse without requiring complete abstinence. Just as there is more than one path to recovery from drug and alcohol addiction, there is more than one path to recovery from food addiction.? ?

Food addiction occupies a gap between substance abuse and eating disorders. Traditionally, these two fields have remained separate and have evolved with different methods of treatment. While much of substance abuse treatment has focused on abstinence, eating disorder treatment has focused on the opposite- lessening restrictions around food. Research has shown that restricting your food intake (abstinence) most often leads to binge eating, loss of control, and other disordered eating behaviors. In addition, classifying foods as ?good? or ?bad? also tends to increase disordered eating, in part because of the judgments that we make about ourselves when we eat a ?good? or ?bad? food. Have you ever thought ?I was bad tonight? based on what you ate? This type of thinking fuels eating disorders.

Of course, we cannot be completely abstinent from food. Unlike drugs and alcohol, we need food to survive. Food nourishes our bodies and provides us with the energy that we need to soar through our day. Since we cannot avoid all foods, what about just eliminating sugar? Sugar is often singled out as a culprit in the addictive process (remember what I said earlier about labeling foods as ?good? or ?bad??). Sugar has become ubiquitous in our food products. It is in everything from breakfast cereal to canned fish to salad dressing to dried fruit to ketchup. In fact, sugar is in most processed foods and restaurant meals. It is nearly impossible to avoid sugar without finding yourself on a highly restrictive diet. And it is exactly this type of restrictive dieting that buys you a seat on the diet-binge rollercoaster.

I believe that mindful eating is our ticket off this ride. Through mindful eating, we learn to eat in tune with our bodies and provide our bodies with the nourishment that it requires to function effectively. Through mindful eating and mindful observation, we may find that certain foods don?t make our bodies-minds feel good and chose not to eat these foods. These foods are available to us should we chose to eat them. They are not off limits. They are neither good nor bad and we are neither good nor bad because we chose to eat or not eat these foods. We make decisions moment-to-moment as we mindfully chose what we will and will not eat.

The bottom line is: do what works for you! If abstinence from sugar has helped curb your problematic eating behaviors then by all means continue abstaining from sugar. However, if abstinence is not working for you and you are continuing to ride the diet-binge rollercoaster, please know that there are other options available to you. There are multiple paths to recovery and you must keep searching until you find what works for you. Healing from disordered eating and food addictions is best done with professional help from a licensed mental health practitioner. I wish you all peace in your relationship with food.?

Support Groups for College Students ? Licensed Mental Health ...

College can be a huge transition for students that usually leads to personal growth, but at times may lead to feelings of loneliness, anxiety and depression.

Many students who I?ve worked with in high school and have graduated and gone off to college, have kept in touch, expressing at times their struggle to adjust or to stay balanced.

Usually I?ll give these students some words of advice or resources I think will help them get back on track, but sometimes they need more attention than I can provide and that?s when I often refer them to a support group on their campus.

There are usually support groups for almost any and every issue a college student may be dealing with including:

Depression and Anxiety

Sudden independence,?academic?pressure, financial worries and adapting to a new environment are all things that can lead to stress and anxiety, especially among freshman.

Stress and anxiety can lead to depression which can cause a host of other problems including dropping out of school and substance abuse. Most college campuses offer groups such as ?Personal Growth? or ??Transitioning into College? ?to serve students with these needs.

There are also grief and loss support groups for students dealing with the loss of someone.

Self Esteem

In college, people often start discovering new things about themselves, things they may like, dislike, feel uncomfortable with or are not quite sure of ?how to deal with their feelings. This is also the time some people have their first sexual experiences either with the opposite sex or with the same sex.

Some may feel like they don?t fit into the student body on campus for various reasons.

These groups help people suffering with self-esteem and?identity?issues figure those things out in a safe, confidential environment.

Most college campuses offer support groups, for example, for the gay, lesbian, bisexual and transgender community and for people who have been sexually assaulted.?The University of Central Florida, for example has a group called Sister Circle, which gives support to women of color.

Recovery

There are also groups for students dealing with drug and alcohol problems in order to help them stay on the track of recovery. In recovery, it?s very important that a person has a good support system, which is what these groups attempt to provide.

Here is an example of support groups offered at the University of Central Florida and similar groups are found on most college campuses:

Generally once I?ve connected a student to a support group on campus not only do I feel relieved, but they also tend to improve and make new friends. I?ve always been a proponent of support groups for everyone in need because I know the positive effects they can have on their members.

Mars rock touched by NASA Curiosity has surprises

ScienceDaily (Oct. 12, 2012) ? The first Martian rock NASA's Curiosity rover has reached out to touch presents a more varied composition than expected from previous missions. The rock also resembles some unusual rocks from Earth's interior.

The rover team used two instruments on Curiosity to study the chemical makeup of the football-size rock called "Jake Matijevic" (matt-EE-oh-vick). The results support some surprising recent measurements and provide an example of why identifying rocks' composition is such a major emphasis of the mission. Rock compositions tell stories about unseen environments and planetary processes.

"This rock is a close match in chemical composition to an unusual but well-known type of igneous rock found in many volcanic provinces on Earth," said Edward Stolper of the California Institute of Technology in Pasadena, who is a Curiosity co-investigator. "With only one Martian rock of this type, it is difficult to know whether the same processes were involved, but it is a reasonable place to start thinking about its origin."

On Earth, rocks with composition like the Jake rock typically come from processes in the planet's mantle beneath the crust, from crystallization of relatively water-rich magma at elevated pressure.

Jake was the first rock analyzed by the rover's arm-mounted Alpha Particle X-Ray Spectrometer (APXS) instrument and about the thirtieth rock examined by the Chemistry and Camera (ChemCam) instrument. Two penny-size spots on Jake were analyzed Sept. 22 by the rover's improved and faster version of earlier APXS devices on all previous Mars rovers, which have examined hundreds of rocks. That information has provided scientists a library of comparisons for what Curiosity sees.

"Jake is kind of an odd Martian rock," said APXS Principal Investigator Ralf Gellert of the University of Guelph in Ontario, Canada. "It's high in elements consistent with the mineral feldspar, and low in magnesium and iron."

ChemCam found unique compositions at each of 14 target points on the rock, hitting different mineral grains within it.

"ChemCam had been seeing compositions suggestive of feldspar since August, and we're getting closer to confirming that now with APXS data, although there are additional tests to be done," said ChemCam Principal Investigator Roger Wiens (WEENS) of Los Alamos National Laboratory in New Mexico.

Examination of Jake included the first comparison on Mars between APXS results and results from checking the same rock with ChemCam, which shoots laser pulses from the top of the rover's mast.

The wealth of information from the two instruments checking chemical elements in the same rock is just a preview. Curiosity also carries analytical laboratories inside the rover to provide other composition information about powder samples from rocks and soil. The mission is progressing toward getting the first soil sample into those analytical instruments during a "sol," or Martian day.

"Yestersol, we used Curiosity's first perfectly scooped sample for cleaning the interior surfaces of our 150-micron sample-processing chambers. It's our version of a Martian carwash," said Chris Roumeliotis (room-eel-ee-OH-tiss), lead turret rover planner at NASA's Jet Propulsion Laboratory in Pasadena, Calif.

Before proceeding, the team carefully studied the material for scooping at a sandy patch called "Rocknest," where Curiosity is spending about three weeks.

"That first sample was perfect, just the right particle-size distribution," said JPL's Luther Beegle, Curiosity sampling-system scientist. "We had a lot of steps to be sure it was safe to go through with the scooping and cleaning."

Following the work at Rocknest, the rover team plans to drive Curiosity about 100 yards eastward and select a rock in that area as the first target for using the drill.

During a two-year prime mission, researchers will use Curiosity's 10 instruments to assess whether the study area ever has offered environmental conditions favorable for microbial life. Is Mo Yan "unworthy" of the 2012 Nobel Prize in Literature ...

mo-yan.jpgMo Yan became only the second Chinese writer to win the Nobel Prize for Literature on October 11, initiating flurries of congratulations and back-patting across the Chinese media. However, some dissidents and human rights observers are unhappy with the award going to a writer with strong ties to the Chinese Communist Party (CCP).

Mo, born Guo Moye in 1955, Shandong province, grew up during the Cultural Revolution, was forced to drop out of primary school to herd cattle, sometimes eating tree bark and weeds to survive. He joined the People's Liberation Army (PLA) in 1976, and began studying literature at the PLA Academy for Arts in 1984.

Mo Yan, a pen-name, means "don't speak" and, according to a speech he gave to the Open University of Hong Kong, was chosen to remind himself not to be too frank when speaking in mainland China.

A number of Mo's books have been banned in China, such as Big Breasts and Wide Hips, set during the Chinese civil war and deemed to be too favourable to the Kuomintang. TIME called Mo one of the most "oft-banned" writers in China. Nevertheless critics, especially dissident Chinese writers, have attacked Mo for being too ready to self-censor and having close ties to the CCP.

"A writer should express criticism and indignation at the dark side of society and the ugliness of human nature, but we should not use one uniform expression," Mo said in a speech at the 2009 Frankfurt Book Fair, "Some may want to shout on the street, but we should tolerate those who hide in their rooms and use literature to voice their opinions."

An especially sore point among dissidents was Mo's involvement in a book released to mark the 70th-anniversary of Mao Zedong's notorious ?Speech at Yan?an Forum on Art and Literature?. Mo was one of a 100 writers and artists who hand-copied paragraphs from the speech, which said that writers who failed to integrate their work into the Communist revolution would be punished.

Mo is vice-chairman of the Chinese Writers' Association, a government-backed organisation which did not comment on the award of the 2010 Nobel Peace Prize to dissident writer Liu Xiaobo (an action that hurt the feelings of the Chinese people but inspired Shanghaiist favourite, the Confucius Peace Prize).

Mo's failure to speak up for imprisoned writers like Liu makes it "inappropriate" for him to win a Nobel, according to human rights lawyer Teng Biao, "On the political front, he is singing the same tune with an undemocratic regime."

Ma Jian, a dissident Chinese author who was banned from ever re-entering China in 2011, has also attacked Mo's subservience to the CCP:

Writers like Mo Yan may show a little criticism of Chinese society in their novels, but when the literary community in China is hurt, as it was with the arrest of Liu Xiaobo, they don?t write about it. They say Liu Xiaobo isn?t an author, he is only concerned with politics.

Jian protested the 2012 London Book Fair, which focused on Chinese works but was criticized for only featuring those authors "approved" by Beijing, including Mo Yan. ?The event is supposed to promote cultural exchange but it co-operates with the perpetrators,? said Independent Chinese PEN Centre (ICPC) president Tienchi Liao.

Grace in Relationships

I love my friends. But I also often struggle with feeling responsible for the behavior and happiness of everyone around me. Can you identify? I will pretty much do whatever it takes to keep the peace and avoid conflict. But I?ve taken that behavior to the extreme. I will offer five hundred restaurants for my group of friends to choose from, but I do not want to be the person in charge of making that final decision. That?s too much pressure. I could choose the WRONG place.

As a recovering ?good girl? I?m learning that having grace-filled relationships doesn?t mean avoiding conflict at all costs. Ephesians 4 does remind us ?keep the unity of the Spirit through the bond of peace,? but I would be doing a disservice to my friendships if I never expressed my own opinion. Loving someone doesn?t mean just appeasing them. Love wants the best for another, even if that process is initially painful.

?It is so hard to receive criticism, but if you can?t you are showing one of the prime characteristics of a fool, according to Proverbs. Understandably, it is easier to receive criticism from someone who really loves you, but even then, it is always hard to listen to something that will bring you pain? My desire for approval sometimes puts me on the defense when it comes to receiving constructive criticism in my life. But thankfully, a new understanding of God?s grace is changing the way I give and receive love. His grace frees me from the need constant approval. Living in light of grace means that love is the highest priority in all relationships.
