The Dow Now: All 30 Components Up In Intraday Trading | Stocks ...

MINYANVILLE ORIGINAL It was good news for President Obama and the markets today, with both cheering the positive jobs report released earlier. Stocks rallied as nonfarm payrolls beat expectations in rising by 163,000 in July.
?
The Dow Jones Industrial Average (^DJI) is trading up 246.24 points (1.91%) at 13,125.12 as of 12:11 p.m. EDT, putting it on its way to snap a four-day losing streak. That?s a 7.33% rise on the year to date and a 10.33% increase from the index?s value a year ago.
?
All 30 Dow components are up in intraday trading. Leading the surge is Kraft Foods (KFT), up 3.98% (+1.55) at $40.49. The company reported second-quarter profit of $0.68 a share on Thursday, which beat analyst estimates by $0.02. Hewlett-Packard (HPQ) is another high-flyer, up more than 4%. The PC maker will have to gain a lot more to make up for lost ground though ? it is still the Dow?s greatest decliner of the year, having fallen 29% thus far.
?
Underwhelming in the wake of the broad rally are McDonald?s (MCD) and Verizon (VZ). The fast food company is up a tiny 0.33%, while Verizon has also increased by 0.47%. A new Forbes report finds that the telecommunications company has spent some $1.8 million in political donations this year, with 58% going to Republicans and 42% to Democrats.
?
The outlook for the rest of 2012 continues to be rocky, despite today?s good news.
?
?We continue to expect growth to slow in the second half of the year as the uncertainty shock from the fiscal cliff weighs on corporate investment,? Michelle Meyer, senior US economist at Bank of America Merrill Lynch, told the Wall Street Journal.? ?This should ultimately trigger additional Fed easing, in our view. That said, today?s report may have bought the Fed some time.?

The Need for Travel Insurance India Plan for Students ?

Make sure that the personal liability in the travel insurance India policy is adequate. It?s good to check on the policy?s cover for accidental death, repatriation of remains and permanent disability. It?s not nice to think about, but nonetheless it?s an important point to consider while buying student medical insurance or?student travel insurance?plans.

If you?re about to take the great leap into the unknown world and have decided to study overseas for a time, one arrangement that shouldn?t be overlooked is your travel insurance India plan especially meant for students. Accidents do happen, and it?s always better to be prepared, so that if something does go wrong, you come through it a bit easier.

The most important items to be covered under travel insurance India plans are medical expenses, dental emergencies, return flights home and personal liability. Other items that are also important are cover for your equipment (because if your laptop isn?t covered it might be hard to study without one should it get stolen) and the cost to replace travel documents.

Student?s travel insurance can provide you with a healthy dose of confidence as you go about your travels. You won?t worry about sudden changes that could ruin your trip when you have insurance coverage that will take care of any unexpected emergencies. You could even consider purchasing student?s travel insurance as an investment, for if you run into problems, accidents, or illnesses on your trip, the insurance will save you money that you otherwise would have lost.

What circumstances does student?s travel insurance or medical insurance cover?

? If your trip is cancelled, interrupted or delayed a travel insurance plan will reimburse you for the money you have spent on transportation, lodging, and other travel costs.

? Suppose your luggage or other personal items are lost, stolen, or damaged. Student?s travel insurance will reimburse you up to a set amount determined by the policy you choose.

? What if you get sick or injured while you are away from home? Student?s travel insurance will pay for your medical expenses if you need care during your trip. And, if you should happen to die while travelling, your remains will be sent back to where you live at no cost to your family.

? Most travel insurance also includes monetary provisions for student?s accidental death or the loss of a limb or sight.

While the most obvious consideration may be budget, be careful not to choose the cheapest student medical insurance or student?travel insurance?over the more comprehensive one. First, make sure that you have a decent medical cover.

ACLU wins appeal against 'extreme' Ariz. abortion ban

By Elizabeth Chuck, NBC News

A law in Arizona that the ACLU is calling?"the most extreme and dangerous of abortion bans" was blocked from taking effect on Thursday?after an emergency appeals request.

Arizona was set to become the ninth state?to forbid doctors from aborting a fetus 20 weeks into a pregnancy.?But unlike elsewhere in the country, Arizona would start the 20-week count after a pregnant woman's last menstrual period, or about 18 weeks into a pregnancy -- which is typically before medical problems can be detected in fetuses in prenatal exams, according to a lawsuit filed by the ACLU and the New York-based Center for Reproductive Rights.

The law, which the U.S. 9th Circuit Court of Appeals blocked Wednesday, will likely be on hold through at least October, when all briefs on the case will be filed, said?Julie?Rikelman, litigation director for the Center for Reproductive Rights. A final decision is likely to be made in November or December, she said.

"We're thrilled with the decision," Rikelman said. "It's really great news for women in Arizona. We're very excited that women will still be able to get the health care that they need."

Under the ban, signed into law in April by Gov. Jan Brewer, R-Ariz., physicians could have their licenses revoked and face jail time if they violate its terms. Exceptions are life-threatening situations or medical emergencies for the mother, which Arizona law defines as a "serious risk of substantial and irreversible impairment of a major bodily function."

Those exceptions were not enough for?The Center for Reproductive Rights and the American Civil Liberties Union, who filed an emergency appeal Monday night after a preliminary injunction they filed in federal court in Phoenix was dismissed.

"This is by far the narrowest health exception in any abortion law in the country," Alexa?Kolbi-Molinas, staff attorney at the?ACLU's Reproductive Freedom Project, said. "It would force a physician who was caring for a woman with a high-risk pregnancy to wait until her condition has deteriorated to the point that it poses an immediate threat of death or major medical damage before offering her the care she needs."

It would also affect expectant mothers who receive disconcerting diagnoses about their fetuses: news that their child won't survive after birth, or will only survive for a short period of time in excruciating pain.

"For a lot of these women, that diagnosis can't be made until after 20 weeks,"?Kolbi-Molinas?said. "This certainly is the most extreme and dangerous of abortion bans that we've seen in some time."

Arizona's late-term ban is the latest in a string of anti-abortion measures being implemented across the country. Alabama, Idaho, Indiana, Kansas, Oklahoma, Georgia, Louisiana, and Nebraska have passed similar restrictions in recent years; North Carolina enacted its own ban, with different specifications to its law, decades ago, said Elizabeth Nash, state issues manager with the?Guttmacher?Institute, a rights organization based in New York.

A?'tidal?wave of abortion?restrictions'?across the U.S.
Nash said there's been "a tidal wave of abortion restrictions" passed recently: Prior to 2011, the most restrictions ever to be passed in a year on the state level was 34, in 2005. But in 2011, a record 92 abortion restrictions were passed, followed by 39 so far in 2012, she said.

Anti-abortion groups are pleased with their recent success in enacting restrictions, particularly the bans on late-term abortions.

"It's a fetal pain law, and it's one of many that have passed in the last few years. We're very pleased," Jeanne?Monahan, director of the Center for Human Dignity at the D.C.-based Family Research Council, said. "This is a law that has to do with the fact that a developing baby can feel pain at a certain time in development and so because of that, abortions are not legal after that period in its development."

Millions of women will no longer have to pay for birth control pills, Pap smears or mammograms and they will also have the right to breast feeding supplies and domestic violence screening. NBC's Kelly O'Donnell reports.

Monahan?lauded other recent anti-abortion wins on the state level -- parental consent and informed consent among them.?

"Anything that can make abortion more rare, I think most people will agree upon,"?she?said, citing a?Gallup poll from May, which found the percentage of Americans who call themselves "pro-choice" is at a record low of 41 percent.

According to the Guttmacher Institute, the increase in these laws is due to a shift in political makeup: state governments becoming more conservative over the past decade, particularly since the midterm elections.

Free birth control under health law starts?

"When the November 2010 elections came about, state legislatures and some governorships moved substantially to the more conservative end," Nash said. "You really had this welcoming environment to adopt abortion restrictions."

In Arizona, the change has been dramatic.

"If we look to 2000, Arizona was classified as a pro-choice state, supportive of abortion rights. For many years, the legislature was fairly hostile to abortion, but there was a governor in place who would veto abortion restrictions," Nash said. "When Gov. [Janet] Napolitano?left for the federal government in 2009, Jan Brewer took over."

The state has passed at least a dozen abortion restrictions in the three years since Brewer became governor, Nash said.

Kolbi-Molinas, the ACLU lawyer, said the Arizona ban could put women in a position where they feel pressure to get an abortion when they might not otherwise.

Watch the most-viewed videos on NBCNews.com

"One of the perverse effects of this law, if it does go into effect, is there are some women who have high-risk pregnancies ... and they may not be able to carry to term, but they really want to try as long as they can," she said. "They would feel pressured to get an abortion before 20 weeks because they wouldn't know if they'd be able to protect their health afterwards."

Up to 90 percent of abortions occur within the first trimester, she added, making the number of women who would even consider getting abortions after 20 weeks only a tiny sliver for Arizona to have to worry about.

"Another thing worth noting is the majority of women who have abortions are already mothers," she said. "If you think about the way this law is putting women at risk if there's something wrong with their health, it's essentially denying them the abortion they might need to return home to their family."

Despite the dozens of restrictions placed on abortion in recent years, anti-abortion advocates aren't gloating.

"In January, we're going to be marking the 40-year anniversary of Roe v. Wade, and approximately 54 million abortions have occurred since that decision in 1973," Monahan, of the Family Research Council,?said. "I don't think it's a moment of victory. It's a somber moment in our country on a lot of levels."

Baby dies of injuries from three-story plunge

Police in New Jersey say they have arrested a man they believe pushed his girlfriend and infant from a third-story window. WNBC's Pei-Sze Cheng reports.

By Jonathan Dienst, NBCNewYork.com

A 3-month-old child who fell out a window and plunged three stories in his mother's arms when the baby's father allegedly attacked them at their New Jersey apartment last week has died, police said.

The baby had been listed in extremely critical condition at the hospital since the brutal attack Friday. His mother is in a medically induced coma in stable but critical condition.

A third woman who was wounded by the suspect when she tried to call 911 was expected to be released from the hospital Tuesday after undergoing emergency surgery.

Twitter suspends reporter's account for NBC tweet

SAN FRANCISCO (Reuters) - Twitter Inc and NBC Universal's move to suppress a British reporter's tweets related to the network's Olympics coverage may have backfired after the incident became fodder for Twitter chatter around the world on Monday.

The microblogging service suspended Guy Adams, the Los Angeles correspondent for London-based daily The Independent, after he sent a tweet on Friday revealing NBC Olympics President Gary Zenkel's email address.

Adams was among a number of Twitter users in the United States who vented their frustration with NBC, a Comcast Corp subsidiary, for showing the London Olympics' opening ceremony on tape delay to coincide with evening prime-time in the United States.

"The man responsible for NBC pretending the Olympics haven't started yet is Gary Zenkel. Tell him what u think! Email: Gary.zenkel@nbcuni.com," Adams tweeted.

As part of his suspension, Adams' account and his tweets were rendered invisible. But in a twist of irony, the incident went viral on Monday, as "Guy Adams" became a worldwide trending topic on Twitter.

In an email to Adams, Twitter informed the reporter that he had violated "Twitter Rules" by posting another user's private information such as "private email address, physical address, telephone number, or financial documents."

NBC confirmed that it had filed a complaint with Twitter.

"A user tweeted the personal information of one of our executives," NBC Sports said. "According to Twitter, this is a violation of their privacy policy. Twitter alone levies discipline."

Adams, who estimated that he has about 4,500 Twitter followers, had been one of the more vocal critics of NBC's coverage. The Monday issue of The Independent carried an article by Adams that was broadly critical of NBC's Olympics coverage, including its commentary of the opening ceremonies, but made no mention of the Twitter incident.

"It's obviously somewhat sinister for a Twitter account to be shut down at the behest of an Olympic sponsor," Adams told Reuters on Monday.

Twitter, which entered into a strategic, non-financial partnership with NBC to curate online content during the Olympics, declined to comment.

Kurdistan Region of Iraq ? Land of Opportunity - Warren Business ...

With over 50B barrels of oil and gas (according to the U.S. Geological Society), under explored acreage and a success rate of over 70%, it is no wonder that the Kurdistan Region of Iraq is attracting oil and gas investor interest.? Indeed the region has less than 2% of all wells drilled in the North Sea.

Add in attractive production sharing contracts and a reasonably low cost environment and the investment case seems compelling.? Companies such as Afren, Maersk, Repsol, ExxonMobil, Marathon, Petroceltic and Chevron have joined long timers in the region such as DNO, Genel Energy, Gulf Keystone and Western Zagros, and the case for further regional consolidation seems strong.

Detractors often site the political risk in Iraq which is driven in part by the fact that the draft Petroleum Law has yet to be ratified by parliament.? These people are concerned that the production sharing contracts signed by the Kurdistan Regional Government (KRG) may be invalid.? In the meantime it is said that investors are yet to receive full payment for exports.

The legal and political risk associated with oil and gas investments in the Kurdistan Region of Iraq is little understood by those working outside the region.? This article attempts to shed some light on the legal risk and is based on a legal opinion given by James Crawford, Professor of International Law at the University of Cambridge*.

Under the Iraq constitution of 2005 the federal government has exclusive responsibility in a number of areas, including foreign policy and defence.? In other areas responsibility falls to the regions.

Also, the constitution suggests that the federal government does not have exclusive power over matters to do with oil and gas.? It recognises that oil and gas resources belong to all the people of Iraq but that management of the resource is shared with the regions.? It also requires federal government and the regions to agree strategic policies to develop oil and gas to the highest benefit of the Iraqi people.? If there is a conflict between regional and federal laws under the constitution then the regional law prevails.

The 2005 constitution identifies the concept of ?present fields?, i.e. those already in production at the time the constitution was agreed.? Oil and gas already extracted from these fields should be jointly managed by the federal government and regional governments, with fair distribution of revenues to be regulated by law.

However, for non-producing and future fields the federal government has no right to play a part in management and there is no requirement for a federally regulated distribution of revenues. ?However, regional management still has to respect firstly the strategic policies made by the federal government jointly with the KRG and, secondly, that oil and gas is owned by all the people of Iraq.? In 2005 all fields in the Kurdistan region fell into this category.

Under the 2005 constitution a revenue sharing law does not need to be in place before oil and gas management activities begin, whether oil and gas is extracted from ?present fields? or otherwise.? The federal government has a right to initiate a revenue sharing law, provided it works with the regions.? However, federal government must propose arrangements for the management of oil and gas extracted from ?present fields?, but this has not been done.

If it had any, KRG could not unilaterally manage any ?present fields? in the absence of ?revenue sharing arrangements.? However, KRG is entitled to manage future fields, in the continued absence of agreed strategic policies.

To provide clarity the federal government has been working with the regions to formulate policy and to develop a hydrocarbon law for the whole of Iraq.? This law has been some time in the making with a draft law proposed in February 2007 which has still to be passed by parliament.? Legal opinion* suggests that the new hydrocarbon law seeks to maximise federal control over oil and gas activity and does not comply with the 2005 constitution.

In the meantime the KRG passed its own law in 2007 in order to expedite the development of the oil and gas industry there.? It is this law that governs the production sharing contracts (PSC) that are in place in the region.? Again, legal opinion* confirms the constitutional authority of KRG to manage the oil and gas resources of the Kurdistan region under its 2007 law, which is in full conformity with the constitution of Iraq.? Therefore KRG has the unqualified authority to agree and implement new contracts, pending agreement with the federal government on strategic policies.? Existing contracts made since 1992 are valid so long as they are consistent with the 2005 constitution.

Given the uncertainty over the proposed Iraq hydrocarbon law and its constitutional underpinning, KRG put in place a temporary arrangement with the federal government whereby all oil export revenues are remitted to the federal government and these are then redistributed to the various regions of Iraq.

However, this informal arrangement has broken down with KRG claiming it is owed $1.5B by the central government which it needs, amongst other things, to recompense foreign investors under their PSCs.? In April 2012 KRG stopped all oil exports, reducing production to around 65,000 barrels per day, all of which is consumed in refineries in the region.

Investors in the Kurdistan Region of Iraq may consider that this legal opinion substantially reduces their legal risk ? the politics of the situation, however, is another matter.

*Professor of International Law James Crawford of Cambridge University legal opinion provided in a paper ?The Authority of the Kurdistan Regional Government over Oil and Gas under the Constitution of Iraq?, 28 January 2008.
